This Technical Note critically analyzes Provisional Measure No. 1,318/2025, which creates the Special Taxation Regime for Data Center Services in Brazil (REDATA). The document examines the environmental, energy, territorial, and regulatory impacts of this infrastructure’s expansion in the country, highlighting the risks of a model based exclusively on tax incentives, without robust sustainability, transparency, and socio-environmental justice criteria.
Drawing on Brazilian environmental legislation, the Federal Constitution, international climate commitments, and recent research, the Note assesses relevant gaps in the government proposal and presents recommendations for more consistent regulation, aligned with sustainable limits and the long-term public interest.
The goal is to strengthen public debate and provide technical input for shaping a socially just and environmentally responsible national data center policy.
